99 Things I Know About You: Terms of Sale and Use
Effective [date of launch]. These terms apply when you play 99 Things I Know About You, buy levels or packs, or tie a ribbon on the Fall in friend wall. 99 Things is made and run by KIRABEN (ABN 85 623 817 667), "we" and "us" below. Questions: hello@kiraben.com.au.
1. Who can play and buy
- You must be [18] or older to play, buy, or tie a ribbon.
- At launch, purchases are available to buyers in Australia only. Visitors elsewhere can join a waiting list.
- There are no accounts. Your access code is how you unlock what you've bought.
2. What you get
- Level 1 (Static) is free. No code needed.
- Paid levels and packs unlock with an access code. A full set code unlocks Levels 2 to 6: you enter it once, and each level opens when you finish the one before. A single level code unlocks that level only. A pack code unlocks that pack's 99 questions.
- Play as often as you like. Replays cost nothing extra.
- Each code works on up to 3 phones. It's for you and the people you play with, not for passing on or selling.
- Your place is saved on the phone you play on. Clearing your browser or switching phones restarts your progress, but your code still unlocks what you bought. We can't restore saved progress because we never hold it.
3. Prices and payment
- Prices are in Australian dollars and include GST.
- Payment is taken through Link, Stripe's checkout service, which sells on our behalf and handles sales tax. Your receipt comes from Link, and your card statement shows LINK.COM* KIRABEN.
- Link's own terms apply to the payment itself. We're responsible for the game, the ribbons and your consumer rights.
- Your code is shown on screen after payment and sent to the email you gave at checkout. If it doesn't arrive, check your junk folder, then email us and we'll resend it.
4. Your consumer rights and refunds
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. If something we sell has a major failure, you're entitled to a refund. If a problem isn't major, we'll fix it, and if we can't fix it in a reasonable time, you can have a refund.
- If something doesn't work (a code won't unlock, a level won't load, your ribbon doesn't appear), email hello@kiraben.com.au and we'll sort it out.
- Change of mind: [Option A: We'll refund any code that hasn't been used, if you ask within 14 days of buying. Option B: We don't offer refunds for change of mind. This doesn't affect your rights under the Australian Consumer Law.]
- Refunds through Link: you can also ask Link for a refund through your receipt. Link may contact us before deciding.
- A refunded code stops working.
5. Ribbons on the Fall in friend wall
- Who can tie one: a ribbon can only be tied by a player who reached Question 99 in a paid game. One ribbon per person, each with its own number. Numbers are never reused.
- What you pay for: your ribbon on the online wall, and a matching real ribbon tied on our physical wall. Online, your ribbon appears once your payment is confirmed. Real ribbons are tied by hand in [weekly] batches and carry their number only, never your name. We'll email you when yours is up.
- Colour: a surprise colour is free and genuinely picked at random. Choosing your colour costs [A$0.50].
- Flare (themes, charms, shimmer and sparkle) appears on your online ribbon and your share image only. The physical wall stays plain.
- Ribbon links: nobody is linked without accepting.
- Removing your ribbon: you can remove it any time, using the link in your ribbon email. A removed ribbon isn't refunded, except where the law requires, because you've had it on the wall.
- Ribbons we remove: we can remove a ribbon that breaks the wall rules. If we do, we'll tell you why.
- If the wall ever closes, we'll email ribbon holders at least [30] days ahead and give you a downloadable image of your ribbon. If you've paid for something we can no longer provide, we'll refund it as the law requires.
6. Playing well
- You choose what to share. Every question can be passed or skipped with "Too close", no reason needed.
- 99 Things is a game, not counselling or therapy. Some packs list support services in case a conversation brings something up. If you or someone you're playing with needs urgent help, call 000.
- Keep other people's secrets safe. Don't share anything about someone who isn't playing that they wouldn't want shared. In the Health Workers pack, never share patient details.
- Work Teams pack: the questions are written to be work-safe, but participation should always be voluntary. The person organising it is responsible for running it fairly at their workplace.
- We don't promise that playing will create or save a friendship or relationship.
7. What's ours, and what you can do with it
- The questions, game, artwork, ribbon photographs, share cards and the names 99 Things I Know About You and KIRABEN belong to Kiraben.
- You can play the game, and share your share cards and "I tied my ribbon" images on social media, as often as you like.
- You can't copy, publish or sell the questions, or use them in another product or service, without our written permission.
8. What you give us
- When you add your first name, or send a testimonial or story, you let us show it as described when you gave it (on your share card, on the wall, or on our website and social media if you ticked the consent box).
- You can ask us to take it down at any time.
- Testimonials are published in your own words. We don't edit them to say more than you did.
9. Fair use
Please don't use bots or scripts, or try to get around the code or payment system; sell, share publicly or post your access code; enter a name that isn't a real first name, or one that's offensive, or someone else's without their permission; or use ribbon links to harass or pester anyone.
We can cancel a code or remove a ribbon if these terms are broken. Where the law requires, we'll refund what you haven't had the benefit of.
10. Changes to the game
- We may improve the game, for example by rewording a question or fixing a screen. We won't remove a level or pack you've paid for.
- If we ever have to close 99 Things, we'll give at least [30] days' notice by email and refund as the law requires.
- If we change these terms, the new version applies to purchases made after the change. It won't take away anything you've already bought.
11. Our responsibility
Nothing in these terms excludes, restricts or changes any right you have under the Australian Consumer Law or any other law that can't be excluded. Apart from those rights, we aren't responsible for loss caused by things outside our control, such as your phone, browser or internet connection.
12. General
These terms are governed by the law of Victoria, Australia. If you have a problem, please email hello@kiraben.com.au first. Most things can be sorted out quickly.
